Movement Classes (Yoga/ /Somatic Movement/Dance/Mobility)

Release I (the undersigned) understand that movement classes require and include physical movements. As with any physical activity, the risk of injury, even serious or disabling, is always present and cannot be entirely eliminated. If I experience any pain or discomfort, I will notify the instructor and either adjust the movement or cease the activity. If I have any existing issues or concerns prior to the class, I will explain them fully to the instructor. I will not push my body too far and will ask for support from the instructor if needed. I understand that the reaction of the heart, lungs, and blood vessel system to the exercises in the Movement Classes cannot always be predicted with accuracy. I understand that there is a risk of certain abnormal changes occurring during or following exercise which may include abnormalities of blood pressure, blood sugar levels, or heart rate, or in rare instances, heart function. Use of weights, and engaging in heavy calisthenics can lead to musculoskeletal strains, sprains, pain, and soreness. And adequate warm up, gradual progression, and adherence to all safety procedures are mandatory. I will not participate in movement classes while under the influence of medicines, sleeping aids, drugs, alcohol or other intoxication. Movement Classes are not a substitute for medical care or diagnosis. I will participate in the Movement Classes after discussing it with my doctor and gaining their approval. I affirm that I alone am responsible to decide whether to participate in the Movement Classes. I hereby agree to irrevocably release and waive any claims that I have now or hereafter may have against re:treat, The Retreat Academy.

Adventures

The program includes off-site adventures such as hiking. re:treat, The Retreat Academy will arrange transportation to all included adventures, it is the responsibility of the guest to be at the departure point at the given time. For trips on the water or to the beach, guests must inform staff if they have any issues with open water, seasickness, if they can’t swim or have any physical issues that prevent participation. Lifeguards will not be present at the ocean or pools included in the trip, guests must only enter the water if they feel they can do so safely. Staff may determine that it is better for the guest not to participate in the tour due to health or safety concerns. Hiking trails are not groomed, they are technical with tree roots, rocks and steep inclines and declines, which brings an inherent risk of injury. Hiking tours are not suitable for those who are not in a state of good physical fitness nor those that have back, knee, joint, heart or breathing problems. Guests not accustomed to hiking must confirm with their doctor if they are able to participate in the hike. Guests must not participate in any tour while under the influence of medicines, sleeping aids, drugs, alcohol or other intoxication. Staff may determine that it is better for the guest not to participate in the tour due to health or safety concerns. In free time, guests can explore however they would like to, re:treat, The Retreat Academy is not responsible for transport or safety during this free time.

Release I (the undersigned) understand that I am responsible for being present at meeting-points at the appropriate time for tours. I will assess my ability and if applicable seek approval from my doctor before participating in tours and notify staff of any restriction that may prevent or hinder participation in the activity. If I have any problems during a tour, I will advise the tour leader. I am responsible for my actions and safety when exploring in my free time and I hereby agree to irrevocably release and waive any claims that I have now or hereafter may have against re:treat, The Retreat Academy.

Breathwork, Meditation, Sound Therapy, TRE

Release I have voluntarily enrolled in this Breathwork/Meditation/Sound Therapy/TRE activity. I understand that I am under no obligation of any kind to participate in this Breathwork/Meditation/Sound Therapy/TRE activity and I voluntarily enter into this Waiver and Release of Liability. I understand that Breathwork/Meditation/Sound Therapy/TRE is a personal growth experience designed to enhance the quality of life, and is not a substitute for psychotherapy and does not substitute for therapy if needed, and does not prevent, cure or treat any mental disorder or medical disease. I agree that the facilitator(s) and re:treat, The Retreat Academy is not and will not be liable for any actions or inaction, or for any direct or indirect result of services provided by the Facilitator(s) and re:treat, The Retreat Academy. I understand that this Breathwork/Meditation/Sound Therapy/TRE activity is not medically supervised nor supervised by licensed medical professionals and that Breathwork/Meditation/Sound Therapy/TRE is not a substitute for any medical diagnosis or medical treatment. I understand that this Breathwork and/or Meditation activity will involve strong connected breathing, guided meditation and/or gentle movement. I understand that Breathwork/Meditation/Sound Therapy/TRE can involve dramatic experiences accompanied by strong emotional and physical responses or releases. I understand that I might find Breathwork/Meditation/Sound Therapy/TRE physically, emotionally, and/or mentally stressful. I hereby affirm that I am in good health and able to participate in this activity. I do not have any physical or mental conditions which would impair my ability to engage in this activity or which would otherwise endanger my health during this Breathwork/Meditation/Sound Therapy/TRE activity, or which would cause any risk of harm to myself or other participants. I have hereby been advised that I should talk to my physician and/or psychotherapist if I had any questions about my physical or mental ability to safely participate in this preferred activity. If I have chosen not to obtain consent from my health/mental health practitioner prior to my participation in Breathwork/Meditation/Sound Therapy/TRE, I hereby agree that I am doing so solely at my own risk. I understand that it is my sole responsibility to participate in activities that are appropriate for the current status of my health and to modify the Breathwork/Meditation/Sound Therapy/TRE activity to accommodate my own needs or limitations. I agree that if there is any change in this representation, I will promptly advise the Facilitator(s). If I have any questions or concerns about whether or not a particular activity is appropriate to my current health status, I understand it is my responsibility to ask my doctor before I participate in such activity.I agreed to indemnify and hold harmless re:treat, The Retreat Academy and their respective directors, officers, employees, agents, and beneficiaries from and against any and all claims and expenses, including attorney fees, arising out of my participation in this Breathwork/Meditation/Sound Therapy/TRE activity. In consideration of my participation in this Breathwork/Meditation/Sound Therapy/TRE activity, I hereby waive and release re:treat, The Retreat Academy and/or any assigns or beneficiaries from any and all claims, costs, liability, and expenses for any injury loss or damage whether known, anticipated, or unanticipated arising from my participation in Breathwork/Meditation/Sound Therapy/TRE.

This Waiver and Release of Liability shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law. I acknowledge that I have thoroughly read this Waiver and Release of Liability in its entirety and fully understand it. By signing this document, I am waiving certain rights I and/or my successors might have to bring legal action or assert a claim against re:treat, The Retreat Academy and/or any assigns or beneficiaries.

Zero Alcohol And Drug Policy

Under no circumstance is alcohol or drug use (that are not outlined in the intake process) allowed during the retreat/program. If there are any suspicious behaviors that indicate the participant is under the influence, the staff will enquire for more information from the participant and may issue a drug or alcohol test. Confirmed use of unapproved drugs or alcohol will result in the participant being removed from the retreat without reimbursement.

Release I (the undersigned), understand that the consumption of alcohol or drugs during the program or retreat is prohibited and is grounds for removal from the program/retreat.

COVID

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people. Rē Precision Health cannot guarantee that you will not become infected with COVID-19. Further, attending this retreat with re:treat, The Retreat Academy could increase your risk of contracting COVID-19. Release By signing this agreement, I (the undersigned) acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that I may be exposed to or infected by COVID-19 by attending this retreat with re:treat, The Retreat Academy and that such exposure or infection may result in personal injury, additional cost, time in quarantine during or after the retreat, illness, permanent disability and death. I understand that the risk of becoming exposed to or infected by COVID-19 prior to or during my trip may result from the actions, omissions, or negligence of myself and others, including, but not limited to, re:treat, The Retreat Academy employees, contractors, retreat participants and their families. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I may experience or incur in connection with my attendance at the retreat with re:treat, The Retreat Academy or participation in the retreat programming (“Claims”). On my behalf, I hereby release, covenant not to sue, discharge, and hold harmless re:treat, The Retreat Academy, its owner, employees, contractors, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of re:treat, The Retreat Academy, its employees, contractors, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in this retreat with re:treat, The Retreat Academy.

General

The programs at re:treat, The Retreat Academy include various therapies as outlined by the program information page. Our programs are not an alternative to your current medical or mental health treatment and we do not claim they will cure any current ailments. Participation in our programs should be approved by your current medical and/or mental health providers. We cannot guarantee results from attendance of our programs, use of our equipment or participation in workshops, classes and activities. We reserve the right to remove attendees who do not comply with the proper registration, security procedures or requirements of attendee conduct outlined below at any point during a retreat/program without a refund. You must not defame, abuse, harass, harm or threaten others, make any bigoted, hateful, or racially offensive statements. You may not advocate illegal activity or discuss illegal activities with the intent to commit them or cause injury or property damage to any person. You may not post or distribute any material that infringes and/or violates any right of a third party or any law or post or distribute any vulgar, obscene, discourteous, or indecent language or images. If we deem any online, social networking, or other media reference post, article, photo or video regarding a retreat/program inappropriate, the offender is required to take down the material immediately upon our request for removal. If the posting is made during a retreat/program, this may be grounds for dismissal from the retreat/program, removal and preclusion from the Sites and future involvement with re:treat, The Retreat Academy. Without limitation of the foregoing, re:treat, The Retreat Academy may, in its sole and absolute discretion, remove a you from a retreat/program, without explanation, either before or during a retreat, if such attendee engages in any unlawful, unauthorized, prohibited, improper, or unethical activities, or any other acts or omissions that we deem worthy of removal from a retreat. Participants must behave in a respectful manner to the staff, other guests, the property and the equipment onsite. Any damages are the responsibility of the part. We highly recommend that guests purchase trip protection and travel insurance in case of unforeseeable travel disruption or injury.

Release I (the undersigned) understand that I am under no obligation of any kind to participate in this retreat program and I voluntarily enter into this Waiver and Release of Liability. I acknowledge the risks involved in the activities and use of equipment on the retreat. I understand all activities and use of equipment are optional and I participate or use the equipment at my own risk. I will evaluate participation in activities and use of equipment after consultation and approval from my medical and/or mental health provider. If I choose not to consult with a medical or mental health professional, I assume sole responsibility for any consequences of my participation in the program. I agree with the rules of attendee conduct. I am deemed to be in a state of physical and mental health that is appropriate to participate in the re:treat program. I understand that this retreat is not a rehabilitation program, there will not be psychiatric or medical supervision or provision of medical detox and that it is not suitable for those dealing with physical dependence on a substance, psychosis, severe depression, suicidal ideation or any other condition that requires specialized medical or mental health care. I understand that re:treat is not a medical or mental health clinic, any medical emergencies will be dealt with at a local hospital at my own cost. I hereby release re:treat, The Retreat Academy and it’s agents from all claims, including but not limited to; personal injury, property damage or destruction and death, indemnifying and holding re:treat, The Retreat Academy and its agents harmless from all claims and liabilities wherefrom, whatsoever.

By checking here, I acknowledge that I bear sole responsibility for my own personal health decisions. re:treat, The Retreat Academy and this program are not a replacement for any medical treatment or advice and will not be held responsible for any decisions I make regarding my own health. *

By checking here, you are waiving that right. After consent, you may, upon written request to us, obtain a paper copy of an electronic record. No fee will be charged for such copy and no special hardware or software is required to view it. Your agreement to use an electronic signature with us for any documents will continue until such time as you notify us in writing that you no longer wish to use an electronic signature.
